Fotiva ("the Service") is a browser-based online photobooth application accessible at fotiva.space. The Service allows users to capture photos using their device's camera, apply decorative frames and stickers, and export the finished photo strips.

The Service is provided to users with both free and paid options. All photo processing occurs locally on your device.

Fotiva reserves the right to modify, suspend, or discontinue any part of the Service at any time without prior notice. We will make reasonable efforts to notify users of significant changes.

By using Fotiva, you agree to use the Service in a lawful and responsible manner. You must comply with all applicable local, national, and international laws and regulations.

You are solely responsible for the content of any photos you capture, edit, and download using the Service. You agree not to use Fotiva to create, distribute, or share any content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.

You must not attempt to interfere with, disrupt, or exploit the Service's infrastructure, including but not limited to: reverse engineering, distributing malware, performing denial-of-service attacks, or attempting to gain unauthorized access to our systems.

You are responsible for ensuring that your device (camera, browser, etc.) is functioning properly. Fotiva is not responsible for any issues arising from hardware or software malfunctions on your device.

All frame designs, graphics, visual elements, logos, icons, animations, and the overall design of the Fotiva application are the intellectual property of Fotiva and its creator, Kevin Mahardyan Saputra, and are protected by applicable copyright and intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to use the Service and its features for personal, non-commercial purposes. This includes the right to download and share your completed photo strips for personal use.

You may not reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any of Fotiva's frame designs, graphics, or other proprietary elements without prior written consent.

Photos you capture using your own camera remain your property. Fotiva claims no ownership over your original photographs.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

Fotiva does not guarantee that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the quality, accuracy, or reliability of any photos captured or processed through the Service, as results may vary depending on your device's camera quality and browser capabilities.

Fotiva is not responsible for any loss of photos or data that may occur during your use of the Service, including but not limited to browser crashes, device failures, or network interruptions.

To the maximum extent permitted by applicable law, Fotiva and its creator shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service.

In no event shall Fotiva's total liability to you for any claims arising from the use of the Service exceed the amount you have paid to Fotiva.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so the above limitations may not apply to you in full.

Fotiva reserves the right to update or modify these Terms of Service at any time. When changes are made, the "Last updated" date at the top of this page will be revised.

Your continued use of the Service after any changes to these Terms constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you should discontinue your use of the Service.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia, without regard to its conflict of law provisions.

Any disputes arising from or related to these Terms or your use of the Service shall be resolved through good-faith negotiation. If a resolution cannot be reached, the dispute shall be submitted to the competent courts in Indonesia.
